Mut’ah

Mut’ah and The amount of mut’ah just ahhave a look at the wise teachings of Islam! When the divorce takes place due to mutual disharmony and anger the relation of marriage which was constructed on the basis of extreme love and affection turns into hatred, antipathy and enmity and the husband wants to disgrace his wife. But, the Glorious Qur’ān orders the husband not to send his wife out of the house in the period of ʿiddah and enjoins him to continue her expenditure till the period of ʿiddah is over and it suggests for him to give her something as gift when departing. This is what the human nature demands and what their long affectionate closeness requires.

The Almighty Allah says in the Glorious Qur’ān: Divorce must be pronounced twice and then (a woman) must be retained in honour or released in a just manner.

Divorce is the name of cancellation of marriage contract. A good-mannered human being should deal with this cancellation of contract goodly as he/she does with other contracts and should not move to anger or engage in quarrels; rather he should deal well when saying good-bye to his wife and give her a present, cloth and so on. This is what the Glorious Qur’ān commands. It says: “And for divorced women a reasonable maintenance is a duty for those who are pious It also reads: “Provide for them, the rich, according to his means, and the straitened according to his means, a reasonable amount.

In the divorce given by husband, providing mutʿah (gifts, garments etc.) to the divorced wife is preferable (mustaḥab) The judges and other responsible people are asked to urge him to give mutʿah (gift) to his wife. In case of being mutʿah as mustaḥab, compelling the husband to provide her with something is not good, however.

As per mutʿah, the divorced women are of four types.

A woman whose dower is not fixed and she is divorced before intercourse and khalwah ṣaḥīḥah complete seclusion.

In this case, the husband is not obligated to give this kind of a divorced woman a dower; but he is responsible to give mutʿah gift.

A woman whose dower is though fixed; but she is divorced before intercourse and khalwah ṣaḥīḥahcomplete seclusion.

The husband is obliged to give half of the fixed dower but if the wife refuses to take or the husband gives all fixed dower, this will be optional case The mutʿah for this kind of women is neither wājib nor mustaḥab.

A woman whose dower is fixed and she is divorced after intercourse and khalwah ṣaḥīḥah complete seclusion.

This kind of woman will get all amount of dower and giving mutʿah to her is also preferred mustaḥab.

A woman whose dower is though not fixed; but she is divorced after intercourse and khalwah ṣaḥīḥah complete seclusion.

This kind of a woman will get mahr al-mithl and giving mutʿah to her is also preferred mustaḥab.

The amount of mut’ah

No amount is fixed for mut’ah rather it depends on the customs and status of a couple. Therefore, the Almighty Allah has ordered to give mutʿah in an excellent manner. The verse of the Glorious Qur’ān: “Provide for them, the rich, according to his means, and the straitened according to his means, a reasonable amount” testifies that the well-to-do and poor husbands should pay mutʿah according to their own means and situations as the financial condition of a husband and the family custom are to be taken into consideration about paying mutʿah. Moreover, the lifestyle of the wife will also be taken into notice. The least amount of mutʿah is one pair of cloth and the big amount is not fixed.

Sayyidnā ʿAbdullāh ibn ʿUmar (ra) says: The amount of mutʿah should be at least 30 dirhams (approximately 92 gm silver or its current value) and Sayyidnā ʿAbdullāh ibn ʿAbbās (ra) is reported to have said: “The best mutʿah is to provide a servant” while Sayyidnā Ḥasan ibn ʿAlī (ra) gave twenty thousands of dirhams (approximately 600 kg silver) as mutʿah-http://dg4.7b7.mywebsitetransfer.com/
